Terms & Conditions
Ordering
All orders are accepted once your payment has been processed. When confirmation of your order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, once payment has completed. All orders are processed as soon as possible and within three working days, unless otherwise stated on our website. We resereve the right at any time before acceptance, to refuse an order or to require further information to process your order. Orders cannot be cancelled once processed.
Delivery
All orders under 2kg in weight or within Royal Mail's small parcel sizing guide will be sent by Royal Mail with your choice of first or second class postage. For orders over these sizes, we will choose an appropriate courier. Our Tracked 24 parcels come with a delivery aim of 1-2 days and Tracked 48, 2-3 days. We cannot be held responsible for parcels undelivered within this time frame. For parcels undelivered after ten working days, we will either re-send your parcel or issue a refund at your discretion. All orders with free postage (over £35 spend offer) will be sent by Royal Mail Tracked 24. Where the product has been damaged in transit, we will either refund your order and postage costs or re-send your order. We will require photographic evidence of this - of both the unopened and opened parcel and contents. We cannot be held responsible for products damaged by heat in transit during the warmer weather, all orders are placed at the buyer's risk. Where Royal Mail and other courier's tracking systems have shown that an item has been delivered, Ruby's Kitchen is no longer held responsible for missing parcels.
Pricing
In the event that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason, we will not be obliged to honour those orders. In the case of a change of price, we will always contact you first to ensure that the price is acceptable. Any offers including voucher codes are only valid on the cost of the product/s and are not applicable for shipping costs. Shipping discounts are based on order value and only applicable to one delivery address.
Gift Vouchers
Once you have purchased a gift voucher from Ruby's Fudge, we will email you an evoucher that you can print out and give away personally or foward in an email. Please note; we do not send out gift vouchers by post. To avoid paying for any postage, please select free delivery for your gift voucher at the checkout (unless you are buying products that require posting too). We reserve the right to charge postage for items bought along with an evoucher unless the total cost of the voucher and products exceed £35. The gift voucher will contain a unique code that can be entered into the voucher/discount code box at the checkout. Ruby's Fudge gift vouchers are; Valid for two years from the date of issue. Non refundable and cannot be exchanged for cash in part or full. Non-transferrable. Not redeemable for cash. Not redeemable to purchase gift cards. May not be sold or transferred. Subject to availability. No replacement for lost of stolen gift vouchers. The terms and conditions of our gift cards shall be amended at any time at the discretion of Ruby's Kitchen and shall be binding by the customer.
Fudge Subscriptions
After purchasing a fudge subscription, the first delivery will be dispatched within three working days of the order and on the same date of each month thereafter until the agreement has ended, unless specified dates have been agreed with ourselves. With regard to your chosen flavours of fudge and fudge sauce, we will endeavour to provide these as equally as possible throughout the term of your subscription. Fudge subscriptions are non-refundable once the first month's order has been dispatched. In the unlikely event of us ceasing to trade, we will refund any difference of monies owed from existing subscriptions to the buyer.
These terms and conditions do not affect your statutory rights.
